Oyster Bay approves foreclosure of golf course via prominent estate

MASSAPEQUA, NY – Oyster Bay city leaders voted unanimously yesterday to purchase the Peninsula Golf Club in Massapequa through a prominent estate, potentially setting up years of legal battles for the acquisition .

City council voted unanimously at its Oct. 26 meeting to begin the purchase for an undisclosed amount. The city said it was making the purchase in order to preserve the golf course as an open park.

“We have to consider everything,” city supervisor Joseph Saladino said at the meeting. “It wouldn’t be in the best interest of our taxpayers to negotiate the price publicly, of course, if we were to buy this property. [Price negotiation] would take place in court through legal proceedings.

According to Newsday, the current owners of the course, PGC Holding Corp., have agreed to sell the 50-acre property to Great American Properties, a Florida-based company, for $ 4.4 million. Approval of the eminent domain would put an end to this sale.

The eminent domain is a process by which governments can seize private property. Governments are constitutionally required to provide fair compensation for property, which is usually market value. This value will be determined by legal proceedings and could be challenged by the current owners.

City officials and residents were concerned that Great American Properties would consider purchasing the golf course in order to redevelop it into housing. The owner of the business told Newsday he plans to keep a golf course and has no plans to make it into housing.

The city, however, did not believe this claim.

“If you look at the company’s website, that’s what they’re doing,” Saladino said. “They’re building houses on golf courses.”

The Great American Properties website says the company’s business plan includes an “aggressive pursuit” of daily rate golf courses across the country. “These courses do not need to be in perfect condition.
